    These general conditions of sale are concluded between the seller (see the legal notices) and any person wishing to make a purchase via this website, hereinafter, the buyer. By validating his order, the Customer declares to accept without reserve the terms of this one as well as the entirety of the present general conditions of sale and declares to have the capacity to conclude a contract with the seller.

    1. OBJECT

    These conditions of sale are intended to define the contractual relationship between the seller and the buyer as well as the conditions applicable to any purchase made through this merchant site. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by the seller. The seller reserves the right to modify its general conditions of sale at any time without notice: the applicable conditions will be those in force on the date of the order by the buyer.

    2- CHARACTERISTICS OF THE PROPOSED WORKS

    The works offered are those presented on this commercial site and which are accompanied by a detailed description. These works are unique and are offered in the limit of a single copy as long as they are visible on the site's shop. In case of unavailability of the product or service after placing the order, the seller will inform the buyer by email: the order will be automatically canceled and no debit will be made.

    3- PRICES

    The prices appearing on this merchant site are understood to include all taxes and processing or transport costs for mainland France (no applicable VAT). The seller reserves the right to modify his prices at any time: the paintings are invoiced on the basis of the rates in force at the time of validation of the order subject to availability. THE PRODUCTS REMAIN THE PROPERTY OF THE SELLER UNTIL COMPLETE PAYMENT OF THE PRICE.

    4 - GEOGRAPHICAL AREA

    The online sale of the products and services presented on this site is reserved for buyers from the countries for which this site is open.

    The artists themselves sending the works to the buyers a flat rate is established for all countries other than metropolitan France

    5- ORDERS

    The buyer who wishes to buy a work online via the site must follow the online ordering process which includes an identification phase, a verification and validation phase of the chosen work, a payment phase under the conditions provided and an order and payment confirmation phase. The confirmation of the order entails the acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase or other conditions. All the data provided as well as the recorded confirmation will constitute proof of the transaction. The seller will send confirmation of the registered order by e-mail, which will constitute acceptance of the order.

    6- PAYMENT

    The price is payable when ordering. Online payments are made by secure system so that no third party can have access to the data transmitted on this occasion. Debits are only made when the order is dispatched.

    Payment is made to the MAJESTIC GALLERY, which retrocedes the sale price to the artist.

    7 – DELIVERY

    The artist is responsible for sending, upon payment received, the work sold to the buyer. It is the artist who chooses the sending formula. Deliveries are made to the address indicated in the order form within the geographical limit specified above. THE RISKS ARE THE RESPONSIBILITY OF THE BUYER WHEN THE ORDER HAS LEFT THE SELLER'S PREMISES. Any protest relating to damage occurring during transport must be made by reasoned complaint, a copy of which will be sent to the artist, to the carrier, within three days of delivery. Delivery times are given as an indication and include processing, routing and shipping. The seller disclaims all liability in the event of non-performance of the contract due to a case of force majeure (strike, fire, flood, etc.).

    8- WITHDRAWAL

    Non-professional buyers benefit from a withdrawal period of seven days from the day of their order. The work(s) will be shipped at the end of this withdrawal period. After dispatch by the seller, no work will be taken back or exchanged without a prior agreement with the Majestic Gallery and the creative artist.

    9- RESPONSIBILITY

    The seller, in the online sales process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption or other involuntary problems, as well as any event qualified as force majeure. The photographs accompanying the products are provided for illustrative purposes but cannot ensure perfect similarity, particularly with regard to colors. In case of doubt or for any additional clarification, it is advisable to contact the seller through the site.

    Personal information is necessary for order management and commercial relations.     All elements of this site are and remain the exclusive intellectual property of the seller. Only use for private use is permitted. Any partial or total reproduction of all or part of the elements appearing on this site is prohibited.

    12- SETTLEMENT OF DISPUTES

    These general conditions of sale are subject to French law. The language of this contract is French. In the event of a dispute, the courts of Laval in Mayenne, Pays-de-la-Loire, France, will have sole jurisdiction.
